Terms of Use and Service

These Terms apply to visitors, account holders and businesses using Buy Local Toowoomba. Separate Billing, Cancellation & Refund and Business Listing & Claim policies form part of these Terms where relevant.

1. About Buy Local Toowoomba

Buy Local Toowoomba is a local business discovery and directory platform. We publish business information, allow authorised representatives to claim and manage listings, provide enquiry and owner-portal functions, and may offer paid directory plans. We are not a party to contracts between visitors and listed businesses.

2. Acceptance of these Terms

By accessing or using the site you agree to comply with these Terms. If you create an account, claim a business, submit content or purchase a paid plan, you confirm that you have authority to do so and that the information you provide is accurate. If you use the platform on behalf of a business or organisation, you represent that you are authorised to bind that business or organisation to the parts of these Terms that apply to it.

3. Eligibility and accounts

  • You must provide accurate account information and keep your contact details current.
  • You are responsible for keeping your password and account access secure and for activity carried out through your account unless caused by our breach of duty.
  • You must not share an account in a way that defeats the platform’s role and permission controls.
  • We may require reasonable evidence of identity or authority where ownership, security or fraud concerns arise.

4. Business information and directory listings

A business listing may be created from information supplied by a business or from publicly available business information. An unclaimed listing is not an endorsement or certification of that business. Business details can change, and visitors should confirm information that is important to a transaction directly with the business.

A business that claims or manages a listing is responsible for keeping its information accurate, lawful and current, including licences, registrations, prices, opening hours, contact details, service descriptions, images and claims made about its products or services.

5. Claiming and managing a listing

Claiming a listing is governed by our Business Listing & Claim Policy. A person who accepts an invited claim or submits a claim confirms that they are authorised to manage the business. Platform authority is determined by Buy Local Toowoomba’s account and organisation-membership records. A CRM contact, email address or marketing tag does not itself give ownership authority.

6. Content you submit

You retain ownership of content you submit where you own that content. You grant us a non-exclusive, worldwide, royalty-free licence for as long as reasonably necessary to host, reproduce, format, resize, moderate and display that content for operating, promoting and improving the Buy Local service and the relevant business listing. This licence ends when the content is removed from the service, except for backups, audit records or material we are legally required to retain.

You must have the rights and permissions needed for anything you upload. You must not submit content that is unlawful, misleading, defamatory, infringing, discriminatory, abusive, malicious, deceptive or likely to compromise another person’s privacy or security.

7. Moderation and listing changes

We may review, format, approve, reject, correct, suspend, archive or remove content where reasonably necessary to enforce these Terms, protect users, comply with law, maintain directory quality or address a genuine dispute. Where practical, we will give the affected business an opportunity to correct a problem before taking material action, unless immediate action is reasonably necessary for legal, security or abuse reasons.

8. Acceptable use

You must not:

  • send spam, bulk or repeated unsolicited messages through an enquiry or contact feature;
  • harass, threaten, deceive, impersonate or unlawfully discriminate against another person;
  • scrape, harvest or bulk-extract listings, contact details or other data except with our written permission or where lawfully permitted;
  • attempt to bypass access controls, rate limits, subscriptions, permissions or security measures;
  • upload malware, interfere with platform availability or probe the service for vulnerabilities without authorisation;
  • use the service for unlawful, fraudulent or misleading activity; or
  • misrepresent an affiliation with Buy Local Toowoomba or another business.

9. Enquiries and dealings with businesses

A phone call, email, website click or enquiry sent through a listing is only an attempt to contact that business. We do not guarantee a response, quote, booking, sale, availability or outcome. Any contract for goods or services is between the visitor and the listed business, and each party is responsible for assessing the other party and the proposed transaction.

10. Paid directory plans

Where paid plans are enabled, the current plan, price, billing interval and inclusions are shown before checkout. For commercial launch, the directory plans are Free ($0), Spotlight ($29 AUD per month or $290 AUD per year) and Local Leader ($99 AUD per month or $990 AUD per year). Spotlight and Local Leader may be purchased on either a monthly or an annual billing interval, and the subscription renews automatically at the selected billing interval unless cancelled. A paid entitlement is granted only after the platform receives and accepts the relevant payment/subscription event; a successful return from a checkout page by itself does not grant paid access.

Cancellation takes effect in accordance with our Billing, Cancellation & Refund Policy. Paid plans do not guarantee any particular number of leads, views, enquiries, search ranking, customers or commercial results.

Our Billing, Cancellation & Refund Policy applies to paid plans and forms part of these Terms. Nothing in these Terms excludes, restricts or modifies any right or guarantee that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.

11. Third-party services

The platform may link to or integrate with third-party services, including business websites, booking systems, payment services, CRM/email tools and cloud providers. Those services operate under their own terms and privacy practices. We are not responsible for independent third-party content or services, except to the extent the law makes us responsible.

12. Intellectual property

The Buy Local Toowoomba name, platform design, software, graphics, branding and original content are owned by or licensed to us. Except as allowed by law, you may not copy, reproduce, republish, sell or create derivative commercial services from our protected materials without permission. This does not restrict a business from using its own information or content that it supplied to us.

13. Availability and changes to the service

We aim to keep the platform available and useful, but we do not promise uninterrupted or error-free operation. We may change features, security controls or technical requirements. For material changes to a paid service that adversely affect an existing subscriber, we will provide reasonable notice where practicable and allow the subscriber to cancel before the change takes effect, unless immediate action is required by law, security or an urgent technical issue.

14. Suspension and termination

You may stop using the service at any time. We may suspend or terminate an account, listing or feature where reasonably necessary because of a serious or repeated breach of these Terms, unauthorised claiming, fraud, non-payment, security risk, unlawful content, or legal requirement. We will act proportionately to the issue and, where practical, give notice and an opportunity to remedy it.

15. Consumer and small-business protections

These Terms are intended to operate fairly and consistently with Australian law, including protections against unfair terms in standard-form consumer and small-business contracts. A term of these Terms does not apply to the extent it would unlawfully exclude a right, remedy, guarantee or protection that cannot be excluded.

16. Disclaimers and liability

To the maximum extent permitted by law, the directory is provided as an information and platform service. We do not guarantee that third-party business information is complete, current or suitable for a particular purpose, or that a listed business will provide any particular outcome. Where the law permits liability to be limited, our liability will be limited in a manner that is fair and reasonable having regard to the service supplied and the circumstances. Nothing in this clause limits liability that cannot lawfully be limited.

17. Governing law

These Terms are governed by the laws of Queensland, Australia. The parties submit to the courts of Queensland and any courts that may hear appeals from them, subject to any mandatory jurisdiction or consumer right that applies.

18. Changes to these Terms

We may update these Terms as the service or law changes. Changes apply from the published effective date. If a change materially affects an existing paid subscriber, we will provide reasonable notice where practicable. Continued use after a notified change takes effect constitutes acceptance to the extent permitted by law; if you do not accept a material change, you may stop using the service and cancel any affected paid plan.
